What If Title Exception Documents Arrive After an ALTA Survey Is Ordered?

Late title exceptions can change an ALTA survey’s research, fieldwork, and delivery scope. Here is what the transaction team should send and confirm.

If the title commitment or its exception documents arrive after an ALTA/NSPS Land Title Survey is ordered, send the new material to the surveyor immediately. Ask the title officer, surveyor, and transaction lead to identify which items require additional research, fieldwork, mapping, or a revised delivery date. Do not assume the first draft already accounts for records the surveyor did not have.

Send the complete title package

Provide the current commitment, the full documents referenced in its exceptions, the property description, and any updated commitment or pro forma that changes the insured estate or relying parties. A list of exception numbers without the underlying instruments may leave the surveyor unable to evaluate where a recorded right affects the site.

The 2026 ALTA/NSPS standards define the surveyor’s responsibilities in relation to title evidence furnished for the assignment. The transaction team should confirm the applicable version and supply complete records rather than treating an old survey or a preliminary title summary as a substitute.

Decide what changes in the work

Ask the surveyor to separate three questions:

  1. Does the new document describe a right or restriction that can be located and shown on the survey?
  2. Does it call for additional field evidence, an expanded work area, or clarification from title or counsel?
  3. Does it affect the agreed certification, optional Table A items, or the date the lender and title team need a usable draft?

The surveyor maps and reports survey matters within the agreed scope. Title interpretation, insurability, and the legal effect of an exception belong with the title and legal teams. If a document is ambiguous or missing an exhibit, identify the unresolved issue on the transaction checklist instead of silently drawing an assumed line.

Reset the handoff, if necessary

Name one person to circulate the current title package and collect comments. Agree which survey version the lender, title officer, buyer, and design team are reviewing. Record any additional work and the revised draft or final delivery milestone before closing documents depend on the drawing.

Terrane’s ALTA Table A guide explains how optional items relate to the transaction. The ALTA survey service covers the underlying deliverable. For a project-specific scope, send the current title material, selected Table A items, relying parties, site access conditions, and the actual review deadline together.

A late document does not automatically require a new survey. It does require a deliberate review of what the existing work can support.
